These terms are the agreement between you and Freewebsite247 LLC (“freewebsite247”, “we”, “us”) for our websites, hosting and related services. By ordering, you accept them. Please read the sections on the 12-month minimum term and the Website Fee in particular.

1. For businesses only

Our services are for businesses and self-employed people buying for their business, not for consumers. By ordering, you confirm you are acting for a business and are authorized to accept these terms for it.

2. What you get

The website build is free when you take a hosting plan. Depending on your plan, we design and write your website, create a logo and artwork if you need them, host it on your domain, set it up on Google, and give you one review round before launch. The current plans and what each includes are shown on our pricing section; the version shown when you order applies to your order.

• Website Hosting: $37.99 a month, including one update every 60 days and 3 months of Facebook posts (3 posts a week) to your Facebook Page.
• Hosting + AI Front Desk: $129 a month plus texts and calls at cost, including one update every 30 days. The optional AI receptionist is $99 a month extra.
• Custom Build: $4,997 one-time for a custom design, then the Hosting + AI Front Desk plan.
• Yearly option: Website Hosting can be paid as $379 for 12 months in advance.
• Second language: one website language is included. Your website in both English and Spanish is $97 one-time, paid with your first payment.
• Extras: extra updates $49 each; new pages $149 each. Urgent fixes (a wrong phone number, address or hours, or anything broken) are always free.

An update covers up to 5 edits to text, photos, prices, hours or services. Unused updates do not roll over. Prices are in US dollars and exclude any sales tax or VAT that applies.

3. 12-month minimum term and billing

Every hosting plan has a minimum term of 12 months. You pay the first month (or the year, on the yearly option) when you order, then monthly in advance on the same date each month, by card or other payment method on file, which you authorize us to charge. If you pay by Zelle or bank transfer instead, you agree to send each payment so it reaches us by its due date. You agree to pay for the full minimum term. After 12 months your plan continues month to month until you cancel. You can cancel any time after the minimum term by emailing team@freewebsite247.com before your next billing date; cancellation takes effect at the end of the period you have paid for.

If a payment fails, we will tell you and try again. If it is still unpaid after 14 days, we may pause your website and services until it is paid. Amounts still due remain payable.

4. What you own

• Your domain. You own your domain name. If we register it for you, we do so in your name. You point it to our servers while you are hosted with us, and when you leave we release it to you.
• Your content. Text, photos, logos and other material you give us remain yours. You give us permission to use them to build, host and promote your website.
• Your website. The design, layout, code, and the text and images we create for your website are licensed to you while you are on a hosting plan with us, and become yours once you have paid for the full 12-month minimum term. If you buy the website outright for $2,599, they become yours straight away. We keep the right to reuse our general templates, components and know-how for other customers.
• Logo and artwork we create for you are licensed to you while your plan is active, and become yours once you have paid for the full 12-month minimum term.

5. The Website Fee

Your website build is free when you host it with us for the 12-month minimum term. Its normal price is $2,599. If, before you have paid for the full minimum term, you or anyone acting for you copy, download, rebuild or host our website design (or a substantially similar version of it) anywhere else without first buying it outright, you agree to pay a Website Fee of $2,599 minus the hosting fees you have already paid us, and you authorize us to charge it to your payment method on file. Once you have paid for the full 12-month minimum term, no Website Fee applies and you can host your website anywhere.

6. Facebook posts

On plans that include them, we post 3 times a week to your Facebook Page for your first 3 months. You give us the Page access we need. You can ask us to change or remove any post. We do not promise any particular number of likes, followers, leads or sales.

7. AI Front Desk, texts and calls

Texts and calls sent through AI Front Desk are charged at what our phone provider charges us, with no markup. Phone carriers require us to register your business for texting, so you agree to give accurate business details. You are responsible for having the consent the law requires (such as under the US Telephone Consumer Protection Act) before you text or call your customers through our tools. AI replies and the AI receptionist can make mistakes, so check important conversations.

8. Your responsibilities

You confirm that the information and material you give us are accurate, that you have the right to use them, and that any licenses, qualifications or claims shown on your website are true. Please review your preview before launch and tell us about anything that is wrong. You may not use our services for anything unlawful, misleading, infringing or harmful, or to send spam.

9. No guarantee of results

We build every site with care and from real search data, but we cannot guarantee search rankings, traffic, leads or revenue. We aim to keep your website online at all times but do not guarantee uninterrupted service.

10. Liability

To the extent the law allows, our services are provided “as is”, and our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim. We are not liable for lost profits, lost business or indirect losses. Nothing in these terms limits liability that cannot be limited by law. You agree to cover our reasonable costs if a third party makes a claim against us because of material you gave us or how you used our services.

11. Data on your website

When people use the forms on your website, we handle their details on your behalf as your processor. We only use that data to provide our services to you, keep it confidential and secure, use only trusted subprocessors (such as Cloudflare and HighLevel), help you respond to requests from those people, tell you without undue delay about any data breach, and delete or return it when you leave us. Where the EU or UK GDPR applies, this section forms our data processing agreement under Article 28; ask us for a signed copy.

12. Ending the service

We may suspend or end your service if you seriously or repeatedly break these terms, including non-payment. When your service ends, we take your website offline and release your domain to you. If you ask within 30 days, we send you a copy of the content you gave us and, once you have paid for the full 12-month minimum term or bought the website outright, a full copy of your website files.

13. Changes to these terms

We may update these terms. We will tell you about important changes at least 30 days before they take effect. Prices for your plan do not change during your 12-month minimum term.

14. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, USA. Either of us may bring a claim in small claims court where it qualifies. Before starting any claim, please contact us so we can try to resolve it.
